Terms of Service
The “General Terms and Conditions” (“GTC”) contain important information about your statutory rights, legal remedies and obligations. By accessing the Rapid Flight Service platform or using the Rapid Flight Service services, you agree to these terms and conditions.
1. Definitions
If “we”, “us” or “our” are mentioned in the terms and conditions “Rapid Flight Service”, this refers to Rapid Flight Service GmbH (company number: FN 000000) with the address 8230 Löffelbach 51, Austria, place of jurisdiction Graz.
Customer:
The Rapid Flight Service customer (including his / her representative (s)) whose data is specified in a charter contract.
Aircraft operator:
The aircraft operator, on whose offer the customer agreement for the execution of the flight is based, under the conditions set out in the charter contract with www.rapidflightservice.com.
Plane:
Any vehicle, with or without an engine, that can fly, e.g. B. an airplane or a helicopter, in connection with the agreed flight.
Flight:
All flights listed in the charter contract, including all flight positioning that the aircraft operator must carry out in order to execute the agreed contract.
Charter contract:
The legally binding contract between Rapid Flight Service and the customer in which the customer agrees to all of the conditions of the aircraft charter set out in the contract.
Charter price:
The price agreed with the customer for the charter trip, which was agreed in the charter contract.
Cancellation:
The customer’s request to cancel the flight or flights according to the agreed charter contract.
2. Scope of services of Rapid Flight Service
Rapid Flight Service GmbH is a service company through which the customer can obtain price quotes and book private charter flights offered by a number of aircraft operators. When booking a charter flight through Rapid Flight Service GmbH, the customer enters into a direct and legally binding relationship with the aircraft operator. As soon as the customer has booked a flight by means of a charter contract, Rapid Flight Service will fully support the customer in its activity as an agent.
3. Validity of offers
An offer is non-binding until an agreement has been made between the customer and Rapid Flight Service in the form of a charter contract. Rapid Flight Service reserves the right to withdraw offers even after agreement with the customer.
4. Cancellation
In the event that the customer requests the cancellation of the flight (s) agreed in the charter contract, the customer undertakes to pay the following compensation to Rapid Flight Service: up to 50% of the full charter contract price after conclusion of the contract. If the cancellation is made within 15 days before the departure agreed in the charter contract, 100% of the full price will be charged.
5. Charter Conditions
Rapid Flight Service acts exclusively as an intermediary between the customer and the aircraft operator. The charter price is paid to the aircraft operator by Rapid Flight Service after deduction of a brokerage fee.
5.1
The customer undertakes to pay for Rapid Flight Service in the currency and payment method specified in the charter contract.
5.2
All prices are subject to industry and fuel-related price fluctuations. If the price increases by more than 5% between the time of the agreement and the departure date, the charter price will be adjusted accordingly and the customer will be billed.
5.3
The charter price agreed in the charter contracts excludes aircraft de-icing, ground transport services, in-flight Wi-Fi (WLAN), SATCOM services and special catering requests, unless this has been expressly stated in the charter contract and agreed with Rapid Flight Service.
5.4
If the aircraft operator is unable to carry out a flight agreed by means of a charter contract due to an aircraft-related cause, war, armed conflict, uprisings, terrorist acts, accidents with aircraft, force majeure of any kind or events, Rapid Flight Service and the aircraft operator according to reasonable, commercial possibilities to find a suitable aircraft replacement and Rapid Flight Service discloses any additional costs to the customer. If Rapid Flight Service’s efforts to find a replacement aircraft are successful, but the customer rejects it, the customer will be billed in full at the price agreed in the charter contract.
If Rapid Flight Service’s efforts to find a replacement aircraft are unsuccessful, the customer will be refunded the agreed price minus the agency fee. In the event of a refund, the refund amount will be calculated on a pro-rata basis based on the percentage of the trip flown. For example, if 4 hours out of a total of 10 flight hours were not available, the customer would be reimbursed 40% of the agreed charter price.
5.5
All charter contracts are based on internationally recognized ICAO and IATA airport codes and not on airport names which may be used in an incorrect form.
5.6
Rapid Flight Service assumes no liability towards the customer in the event of denied boarding due to customs, police, health, immigration and other legal provisions of a state to or from which the aircraft is to be flown.
5.7
Rapid Flight Service will do its best to help the customer to communicate all legal travel regulations applicable at the time of the flight. These requirements include the validity of passports, visas and / or health certificates (“sufficient travel documents”) which must be presented to the relevant government authorities by all passengers, both on departure and on arrival. However, it is the customer’s responsibility to ensure that all passengers are in possession of adequate travel documents.
If a passenger is denied boarding on departure or entry on arrival due to insufficient travel documents being presented, the customer is liable for any additional costs incurred by that passenger.
If the aircraft operator cannot operate a flight because a passenger does not provide sufficient travel documents, the flight will be treated as canceled by the customer and the general Rapid Flight Service cancellation conditions apply.
6. De-icing
In the event of aircraft de-icing costs (including aircraft hangars), the customer is fully responsible for reimbursing the aircraft operator for these costs.
Rapid Flight Service requires a credit card reservation for the approximate cost of a possible de-icing. If the customer does not have the de-icing costs insured by credit card, Rapid Flight Service is entitled to charge the customer for the payment of the de-icing costs.
